Terms of Use

The short version: your licence to use Thatplace is Apple's, and these terms add to it rather than replace it. Data can be lost, so keep your own backups — of your photo library and of everything else. We provide the app as it is, we warrant nothing about it, and our liability is limited. Purchases are handled by Apple.
1. These terms add to Apple's, they do not replace them
These Terms of Use are an agreement between you and Five to Nine, LLC, a Kentucky limited liability company ("Five to Nine", "we", "us"), covering the Thatplace app for iPhone, iPad and Mac and the pages on thatplace.io. By installing or using Thatplace you accept them. If you do not accept them, do not use the app.
Your licence to use Thatplace is Apple's Licensed Application End User License Agreement, which you accepted through the App Store and which continues to apply in full. These terms are additional to it and cover the things it does not: how the app behaves, what it does and does not promise about your data, and what we ask of you when you use it.
Where these terms and Apple's licence agreement conflict, Apple's governs as far as the licence is concerned. Nothing here reduces any right Apple's agreement or the App Store's Usage Rules give you, and nothing here is a promise made on Apple's behalf.
This agreement is between you and us alone. Apple is not a party to it and is not responsible for Thatplace or its contents.
Our Privacy Policy explains what the app does with information, and forms part of this agreement.
2. Using the app
Apple's licence agreement, linked above, is what grants you the right to use Thatplace and sets out the limits on that right — the devices you may use it on, the members of your Family Sharing group who may use it, and what you may not do with the software. We do not grant the licence and we do not restate it here; read Apple's for the terms that govern it.
What we add is only this: the licence is for your own use of your own photos, whether personal or commercial, and Thatplace is licensed rather than sold. We keep all rights in it that are not expressly granted.
3. Your data, your backups — Thatplace is not a backup
Keeping backups is your responsibility, and that includes your photo library. Thatplace is a tool you point at data you already have. It is not a backup service, not a storage service and not a system of record, and it must not be relied on as the only copy of anything.
Thatplace reads your photo library and creates a database of its own: your trips, the places in them, your ratings, your notes and your corrections. Data can be lost, corrupted, altered or made unavailable in any number of ordinary ways — a device lost, stolen or broken; an app deleted; a problem with iCloud or another service; a defect in Thatplace or in software we do not control; or a change you make and cannot reverse.
We give no warranty, of any kind, that any data will be preserved, left unaltered, or be recoverable. That applies to everything reachable from the app — your trips, places, ratings, notes and shared lists, and your photos and photo library — however the loss comes about. To the fullest extent the law allows, we are not liable for it.
So please:
- Keep your device backed up — iCloud Backup or an encrypted computer backup on iPhone and iPad, Time Machine or equivalent on a Mac. That is what actually protects both your photos and the work you have put into your trips.
- Turning on iCloud syncing in Thatplace is not a backup. It keeps your devices in agreement with each other, which means a deletion on one device is a deletion on all of them.
- Some actions in the app are permanent and say so before they run. Removing a place removes it from every trip along with its rating and notes, and cannot be undone. Undo history does not survive quitting the app.
- Keep your own copies of anything you would be sorry to lose, before you use Thatplace and while you go on using it.
4. Thatplace Pro, and what free gives you
Thatplace is free to use and keeps one imported trip at a time. Thatplace Pro lifts that limit and is offered both as a one-time purchase and as a yearly subscription. Prices are shown in the app and on the App Store in your local currency before you buy, and may change.
All purchases are made through Apple. We never see your payment details. Payment is charged to your Apple Account.
A yearly subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours of the period ending. You can manage or cancel a subscription in Settings → your name → Subscriptions on iOS and iPadOS, or in App Store → Account Settings on a Mac. Cancelling stops future charges; it does not refund the period you are in.
Refunds are Apple's to give, under its own terms, and requests go to Apple rather than to us.
Nothing you have already saved is ever taken away. If a subscription lapses, or you are over the free limit for any other reason, the next import is refused and nothing else — every trip you already have stays readable and editable. The app has no ability to delete your trips for a billing reason.
5. Your content
Your photos, your trips, your notes and your ratings are yours. We claim no ownership of them and no licence to use them. We do not receive them: see the Privacy Policy.
6. Sharing places
Thatplace can turn a selection of places into a link or a document you send to somebody. If you use it, you are responsible for what you send and who you send it to. A link can be opened by anyone who has it until it expires or you end it, and ending it cannot take back places somebody has already added to their own app.
A list somebody shares with you is their content, not ours. We do not review shared lists and we are not responsible for them.
7. Acceptable use
Use Thatplace lawfully. Do not use it to infringe anyone's rights, to handle photos you have no right to, to interfere with the app's operation or security, or to work around its purchase limits.
8. Our intellectual property
Thatplace, its name, its icon and its design are ours or our licensors' and are protected by copyright and trademark law. Nothing in this agreement transfers them to you.
9. The app may change
We may add, change or remove features, and we may stop offering or supporting Thatplace. We will not knowingly release an update whose only effect is to take away trips you have already saved.
10. No warranty
Thatplace is provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
In particular, and by design: Thatplace makes guesses. It works out where a trip went and what businesses were in it from photos and from Apple Maps, and it can be wrong. The app hedges when it is unsure and lets you correct it, but no part of it should be treated as an accurate record of where you were or when. Do not rely on it as evidence of anything.
Descriptions of Thatplace are not warranties. Anything we say about how the app works or is built — on thatplace.io, in the App Store, in the app's own screens, in its Privacy Policy or in any documentation or support material — describes how it is designed to behave. Those are descriptions, and none of them creates a warranty, guarantee or condition, or adds anything to this agreement.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits the rights you have as a consumer that cannot be limited by agreement.
If Thatplace fails to conform to any warranty that cannot be disclaimed, you may notify Apple and Apple will refund the purchase price if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Thatplace.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, or the loss, corruption or alteration of data of any kind — including photos and photo libraries — arising out of or relating to Thatplace, whether or not we were told such damages were possible.
Where liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you paid us for Thatplace in the twelve months before the claim, or US$50.
Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
12. Maintenance and support
We are solely responsible for any maintenance and support for Thatplace. Apple has no obligation to furnish any maintenance or support services for it. Support requests go to support@thatplace.io, and we answer what we can — but this is a small operation and no response time is promised.
13. Claims about the app
We, not Apple, are responsible for addressing any claim by you or a third party relating to Thatplace or your use of it, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law.
If a third party claims that Thatplace or your use of it infringes their intellectual property, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
14. Legal compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You will comply with all applicable third-party terms when using Thatplace.
15. Apple's services
Thatplace uses Apple Maps, iCloud and the App Store. Your use of those is governed by Apple's own terms and privacy policy, not by this agreement, and we are not responsible for them.
16. Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Kentucky have exclusive jurisdiction — except that nothing in this section deprives you of the protection of the mandatory consumer law of the country where you live, or of the right to bring a claim there.
17. Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this agreement, and have the right to enforce its terms against you as they relate to your licence to use Thatplace.
18. Termination
You may end this agreement at any time by deleting Thatplace. We may end it if you materially breach it. Sections 3, 5, 8, 10, 11, 13 and 16 survive it.
19. General
If a provision of this agreement is unenforceable, the rest stands. Our not enforcing a provision is not a waiver of it. This agreement and our Privacy Policy are the whole of what we ask of you about Thatplace — alongside Apple's licence agreement and the App Store's terms, which apply on their own account and are not affected by anything here. We may update these terms; the date at the top changes when we do, and continuing to use the app after a change means accepting it.
